JOY-CON DRIFT LAWSUIT

Both the left and right stick of Joy-Con 1s and Joy-Con 2s are predisposed to stick drift which causes ghost movements and inaccurate joystick detection. Lambert Avocatz filed a class action lawsuit against Nintendo to seek compensation for those affected by Joy-Con Drift before ultimately being dismissed due to Nintendo's EULA protecting them against legal action. To avoid backlash repairs were able to be placed on Joy-Cons for free with shipping being covered. However these same mechanical parts are being used years later to construct the new Switch 2 Joy-Cons which once again puts the burden of functionality on the customer filing for multiple repairs.

LEGACY GAMES PRESERVATION

Over 90% of Nintendo's retro game library has remained unavailable for reasonable legal purchase in 2025. Despite the efforts of game preservationists and romsites to archive content from abandoned consoles, Nintendo has sued and served takedown notices while failing to provide an alternate way to experience these games. New content being made of these older games through romhacks, fan games, and native PC ports have also been legally terminated through DMCA notices. There is clear corporate intention to lock these games behind paywalls such as Nintendo Switch Online and leave other beloved IPs defunct.

CONTENT CREATION STRIKES

Online videos containing IPs from Nintendo have frequently been the target of copyright strikes via YouTube and Twitch. Whether the video features older Nintendo games running on an emulator, modded versions of recently released titles, or simply includes their music in the background of the video/stream. These copyright strikes serve to silence channels that feature their IPs in a way that goes against their ideal vision. This can lead to a massive loss of revenue and shutdown a channel altogether if multiple claims are cited.

COMMUNITY GAME TOURNAMENTS

Fan run events for competitive games such as Smash Ultimate, Splatoon, and Melee have received shutdown requests when entrant numbers grow too large. Tournament organizers are mostly left in the dark and take on major financial risks when investing into larger events because a shutdown request can force refunds on travel visas and hotel bookings. Instead of investing and incentivizing the growth of these tournaments, Nintendo chooses to restrict and punish those showing the most passion for their games.
